Terms of Service
Wliki Private Limited (the "Marcadeo") manages a web/mobile application and operates the website https://www.wliki.ai. Together, the App and the Website are referred to as the “Platform.” These terms and conditions (“Terms”) regulate your use of or access to the Platform and the Services (as defined below).
This document serves as an electronic record in accordance with the Information Technology Act, 2000, and its applicable rules. These Terms form a binding and enforceable legal agreement between Wliki Private Limited (the “Company”) and you, the User (as defined below), or any end user of the Services (collectively referred to as “you”). You affirm and guarantee that you (a) have the full legal capacity and authority to accept and be bound by these Terms, (b) are at least 18 (eighteen) years old, and (c) are a resident of India. If you are acting on behalf of an entity, organization, or any other legal entity, you confirm that you have the necessary authority to bind that entity, organization, or legal person to these Terms.
These Terms include our privacy policy, available at (“Privacy Policy”), as well as any internal guidelines, additional terms, policies, or disclaimers that we may provide or issue from time to time. By continuing to access or use the Platform or any Services provided on it, you acknowledge and accept these Terms.
The Company has the right to update these Terms by posting a revised version. Your ongoing use of the
Platform, or your choice not to delete it, will indicate your acceptance of these changes. Therefore, we
recommend that you periodically review the Terms whenever you access or use the Platform to stay informed
about any modifications we may make.
By using the Services, you acknowledge that you have read and understood these Terms and agree to be bound by
them, as well as to comply with the requirements set forth. If you do not agree with any part of these Terms
or are unable to meet the requirements, please do not access the Platform or utilize the Services.
Services
Creatormon Private Limited (“Wliki”) operates the online platform at wliki.ai (the “Site”), as well as applications like Wliki (the “Apps”) (collectively referred to as the “Services”). Our Services enable users to shop for products recommended by their favorite Influencers and explore curated content. Through our platform, you can easily discover and purchase styles you love from thousands of Influencers, including individuals and entities with websites, blogs, social media presence, agents or agencies, digital publishers, and other content platforms. As a registered user of the App, you can seamlessly find, follow, and shop influencer content directly within the App. We may also send you emails featuring content and Influencers that align with your interests. Our Services create valuable connections between third-party retailers, advertisers, and other businesses (“Merchants”), Influencers, and consumers (“You,” “Your,” and “Users”). We strive to provide you with a free, enjoyable, and convenient shopping experience while facilitating the marketing and sales of Merchant products and services (collectively referred to as “Products”) and ensuring that Influencers receive their commissions.
Access to Our Services Eligibility
To use our Services, you must meet the following requirements: (1) you must be at least 18 years old, and (2) you must either be legally able to enter into this Agreement on your own or have a parent or legal guardian do so on your behalf. Our Services are intended solely for individuals aged 18 and older. If you are 18 or older but not yet of legal age in your jurisdiction, you agree to discuss this Agreement with a parent or legal guardian to ensure that both of you understand and accept its terms. If you are a parent or legal guardian agreeing to this Agreement for your child who is over 18, you acknowledge that you take full responsibility for your child’s use of the Services. Wliki does not encourage, solicit, or permit access to the Services by anyone under the age of 18.
Registration
You agree to provide specific information to establish your account. As part of the registration process, you will select a username and password and may be required to submit additional details. By doing so, you consent to Wliki's collection and access to your personal information. By registering for the Services, you authorize Wliki to send you emails and other communications. You are responsible for keeping your password secure and must not share your account with anyone else. You are solely responsible for maintaining the confidentiality of your username and password. You may not allow others to use your account, nor may you share, assign, or transfer your account or login information to any other individual or entity. You are accountable for all activities conducted through your account. Wliki has the right to assume that anyone using your username and password is you. You agree to inform Wliki immediately of any unauthorized use of your account. Wliki reserves the right to change, modify, or amend your username and password at any time. You agree to provide accurate information and to keep it updated. You also agree to use our Services only for personal purposes and not for competitive reasons. You represent and warrant that the information you provide to Wliki is accurate, truthful, non-confidential, and does not violate any contractual obligations or third-party rights. It is your responsibility to ensure that your information remains accurate and current. Furthermore, you confirm that you are not a competitor of Wliki and are not using the Services in competition with us. Additionally, you affirm that you are using the Services solely for personal reasons and are not an attorney or acting on behalf of an attorney conducting an investigation related to potential claims involving the Services, any materials accessible through the Services, or Wliki.
Updates
We may provide you with updates from time to time and may require you to use the latest version. Wliki reserves the right, at its sole discretion, to substitute, replace, modify, update, or upgrade the Services as it sees fit (“updates”). All such updates will be incorporated into and governed by this Agreement and will remain the exclusive property of Wliki. If Wliki provides you with any updates, you will be required to use that version. Wliki will only support the most recent version provided to you. Depending on the update, you may not be able to use the Apps until you have downloaded the latest version and accepted any new terms that may apply. In the event of a conflict between this Agreement and any other terms related to updates, the latter will take precedence. This section does not obligate Wliki to deliver new features, functionalities, or any future products that may be offered.
Support
We may provide user support services. Wliki reserves the right to discontinue, modify, or cancel any technical support at any time.
Messages
You agree to receive communications from us, including marketing materials. This may involve notifications and marketing messages sent through the Services or to your contact information, such as your email address. It is your responsibility to ensure that Wliki has your current email address at all times. Any notice sent to you via the email address you provide will be considered as delivered, received, and acknowledged by you, regardless of whether you actually receive or read it.
Automated Processing
We may provide relevant content to you and others through automated processing. Our Services include making recommendations for content that may interest you and others. We use the information you provide, along with data we have about other users, to generate these suggestions.
Rights and Restrictions on Use Warnings; Disclaimers
Our Services may feature content from third parties, including Influencers and Merchants, over which we have no control. We disclaim any liability for such content. You understand that Wliki is not responsible for any harm that may arise from statements presented on the Services, including opinions and statements about products viewed through the Services or third-party advertisements and services linked or posted on the Services. Any statements made by Wliki, its employees, agents, or affiliates are intended for informational purposes only. Wliki reserves the right to discontinue the Services or alter the content at any time, with or without prior notice to you, and without incurring any liability. Wliki makes no representations, warranties, or guarantees, whether express or implied, regarding the quality of any products or services advertised, offered, or provided by any Merchant, or any statements made by Influencers or other individuals, companies, or service providers utilizing or featured on the Services, and assumes no responsibility in connection with these matters.
Your License to Wliki
You grant us a non-exclusive license to use your Content. You provide Wliki with a non-exclusive, perpetual, worldwide, royalty-free license to use, host, store, transmit, reproduce, distribute, sublicense, modify, create derivative works, communicate, publish, publicly perform, publicly display, archive, and otherwise utilize your Content, in whole or in part, in any manner, medium, or form, whether currently known or developed in the future, at Wliki's sole discretion. This includes, but is not limited to, using your Content for the operation, promotion, and enhancement of our Services. Additionally, you grant Wliki the right to syndicate your Content for any purpose, including using such syndicated Content to promote the Wliki brand. You also grant Wliki all necessary rights to facilitate your use of third-party sites, apps, or services that require syndication or other use of your Content in connection with Wliki.
Warnings; Disclaimers
If you choose to share content through the Services in publicly accessible areas, you do so at your own risk. Wliki is not liable for, and explicitly disclaims any responsibility for, the use or disclosure of any information, communication, or content that you voluntarily provide through the Sites or any of the Apps in areas where it can be viewed, copied, or used by others
Links to Other Sites, Networks, Platforms, and Apps
Accessing Linked Technologies is done at your own risk. We are not liable for any actions taken by third parties. The Services may feature links to third-party sites, networks, platforms, or apps (“Linked Technologies”), which may include advertisers. Please be aware that Wliki cannot control and is not responsible for the terms of service or privacy policies of these Linked Technologies. We recommend that you exercise caution when leaving the Services and review the relevant agreements for each Linked Technology you visit. This Agreement pertains solely to our Services. Wliki does not accept responsibility and makes no guarantees regarding Linked Technologies, including but not limited to their content, accuracy, opinions, functionality, or services. The presence of any Linked Technologies on the Services does not imply endorsement or approval by Wliki. If you choose to access any Linked Technologies, you do so at your own risk.
Supplementary Terms of Service for Content Creators
This Creator Service Level Agreement ("SLA") sets forth the terms and conditions that govern your participation in the Wliki Creator Program (the "Program"). In this document, "We," "Us," or "Our" refers to Wliki, while "You" or "Your" pertains to the applicant. The term "Brand Site" refers to the official website of the brands involved in the Program. The term “Creator” describes an individual who engages in activities related to brand promotion and advertising. This includes, but is not limited to, influencers, content creators, bloggers, social media figures, or website owners who maintain an audience through their content. By checking the box to confirm your agreement with the terms and conditions of this SLA, or by continuing your participation in the Program after we post any updates, revised SLA, or modified terms on the Wliki site.
